Aiven Acceptable Use Policy

  1. The Customer shall ensure that its users do not utilize the Cloud Services in violation of this Acceptable Use Policy. The Customer is responsible for ensuring that the Cloud Services are not used:
    1. to violate, or encourage the violation of, applicable laws (including without limitation criminal laws, or any third-party rights including privacy or publicity rights);
    2. to infringe or misappropriate a third-party’s intellectual property or proprietary rights;
    3. to perform significant load or security testing without first obtaining Provider’s written consent;
    4. to engage in, promote or facilitate unlawful, hateful, discriminatory, or violent causes, including terrorism or violent extremism;
    5. for any unlawful, abusive, harassing , defamatory, obscene , harmful or fraudulent purpose (for example, this may include phishing, creating a pyramid scheme or mirroring a website);
    6. to intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature;
    7. to violate security or integrity of any network, computer or communications system, software application or network or computing device (such violations to include without limitation unauthorized access, interception of data or traffic or falsification of origin);
    8. to make connections to any users, hosts or networks unless the Customer has permission to communicate with them (such network abuses to include without limitation monitoring or crawling, denial of service attacks, intentional interference, operating open proxies, open mail relays or open recursive domain name servers, or to avoiding system restrictions);
    9. to intentionally or unintentionally interfere with the the equipment used to provide or the availability of the Cloud Services , for other users;
    10. to disable, interfere with or circumvent any aspect of the Cloud Services;
    11. to generate, distribute, publish or facilitate unsolicited mass email, promotions, advertising or other solicitations ("spam"), including alteration or obscuring mail headers or assuming sender's identities, collecting replies to messages sent from a third party provider if such messages would violate the policies set out herein or comparable policies of such third party;
    12. for using the Cloud Services in a manner that violates any applicable third-party policies, applicable industry standards, or requirements that Provider may communicate to users;
    13. for engaging in high risk activity, where use or failure of a Cloud Services may result in the death or serious bodily harm of an individual, or in significant damage to physical property;
    14. for accessing a third-party sites for the purpose of web scraping, crawling, monitoring or other similar activity through a web client that does not take commercially reasonable efforts to identify itself via a unique user agent string describing the purpose of the web client and obey the robots exclusion standard, including the crawl-delay directive; or
    15. to use the Cloud Services, or any interfaces provided with the Cloud Services, to access any other product or service of the Provider or its subcontractors or Subprocessors in a manner that violates their applicable terms of service.
  2. Customer’s Users may not utilize a temporary “dead-drop” email address for the email address of their Aiven account.
  3. The Provider (and its subcontractors and Subprocessors where appropriate) reserve the right but assume no obligation to review the Customer's use of the Cloud Services, including the Customer's data to ensure compliance with the Acceptable Use Policy and/or applicable law and to discontinue any use by the Customer of the Cloud Services and removing and/or disabling access to any infringing data of the Customer. The Provider (and its subcontractors and Subprocessors where appropriate) may report suspected infringing activities to officials, regulators or other appropriate third parties, including the disclosure of appropriate information regarding the Customer.
  4. If the Customer becomes aware that its use of the Cloud Services infringes the Acceptable Use Policy set out herein, the Customer agrees to immediately cease the infringing use of the Cloud Services. The Customer shall promptly comply with Provider’s requests in regard to the ceasing of use of the Cloud Services that infringes the policies set out herein.
